CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 - 45 <br />By: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO THE <br />MAINTENANCE, SUPPORT AND LIFECYCLE MANAGEMENT <br />ADDENDUM TO THE MOTOROLA SOLUTIONS, INC. <br />COMMUNICATIONS SYSTEM AND SERVICES AGREEMENT <br />AUTHORIZED BYORD. 2023-27, AND DECLARINGANEMERGENCY. <br />WHEREAS, the Director of Public Safety has recommended that the City of North <br />Olmsted enter into an addendum to the contract to purchase / lease the Motorola Model <br />MCC7500E console for necessary maintenance, vital support and advanced plus lifecycle <br />services; and <br />WHEREAS, the proposed addendum runs concurrent with the five (5) year lease <br />agreement for the Motorola consoles; and <br />WHEREAS, the addendum calls for four (4) separate annual payments payable in years <br />two (2) through five (5) of the lease, for a total of $245,289.00; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into the <br />addendum to the Communications and System Services Agreement with Motorola Solutions, Inc. <br />for maintenance, support and advanced plus lifecycle services. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and she is hereby authorized to enter into an addendum <br />to the Communications and System Services Agreement with Motorola Solutions, Inc. for <br />maintenance, support and advanced plus lifecycle services at a cost of $245,289.00. Said <br />Agreement shall be in the form and substance as attached as Exhibit A, with only such changes <br />in form and substance that are not substantially adverse to the City and which are approved by <br />the Director of Law. The character of the Agreement as not being substantially adverse to the <br />City shall be evidenced conclusively by the execution of the agreement by the Mayor and the <br />approval of the contract by the Director of Law. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately to support leased <br />equipment and avoid anticipated price increases; and further provided it receives the affirmative <br />vote of two-thirds of all members of Council, it shall take effect and be in force immediately <br />upon its passage and approval by the Mayor. <br />
