CITY OF NORTH OLMSTED ORDINANCE NO. 2023 - 45 By: Mayor Jones AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO THE MAINTENANCE, SUPPORT AND LIFECYCLE MANAGEMENT ADDENDUM TO THE MOTOROLA SOLUTIONS, INC. COMMUNICATIONS SYSTEM AND SERVICES AGREEMENT AUTHORIZED BYORD. 2023-27, AND DECLARINGANEMERGENCY. WHEREAS, the Director of Public Safety has recommended that the City of North Olmsted enter into an addendum to the contract to purchase / lease the Motorola Model MCC7500E console for necessary maintenance, vital support and advanced plus lifecycle services; and WHEREAS, the proposed addendum runs concurrent with the five (5) year lease agreement for the Motorola consoles; and WHEREAS, the addendum calls for four (4) separate annual payments payable in years two (2) through five (5) of the lease, for a total of $245,289.00; and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into the addendum to the Communications and System Services Agreement with Motorola Solutions, Inc. for maintenance, support and advanced plus lifecycle services. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and she is hereby authorized to enter into an addendum to the Communications and System Services Agreement with Motorola Solutions, Inc. for maintenance, support and advanced plus lifecycle services at a cost of $245,289.00. Said Agreement shall be in the form and substance as attached as Exhibit A, with only such changes in form and substance that are not substantially adverse to the City and which are approved by the Director of Law. The character of the Agreement as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the contract by the Director of Law. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Ordinance go into effect immediately to support leased equipment and avoid anticipated price increases; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
