CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2023 - 56 <br />BY: Mayor Jones <br />A RESOLUTION DISPENSING WITH THE FORMAL RFP PROCESS <br />AND AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT <br />WITH SIXMO COMPANY TO PROVIDE CONSTRUCTION <br />MANAGEMENT SERVICES FOR THE SENIOR CENTER AND <br />COMMUNITY CABIN KITCHEN RENOVATION PROJECT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City has utilized SIXMO Company to provide services for the Senior <br />Center and Community Cabin Kitchen Renovation Project; and <br />WHEREAS, the Director of Recreation and Public Engagement has been satisfied with <br />the quality of the professional services provided and believes that an extension of that <br />relationship is warranted and necessary; and <br />WHEREAS, Section 112.10(b) of the Administrative Code provides, as an exception to <br />the RFP process, that the City may, upon approval of the Council, dispense with a formal RFP if <br />the services sought are of a continuing nature; and <br />WHEREAS, it is the desire of this Council, based upon the recommendation of the <br />Director of Recreation and Public Engagement, to authorize the Mayor to enter into an <br />agreement with SIXMO Company to continue to provide such construction management <br />services. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTYOF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be, on behalf of the City of North Olmsted, and she is <br />hereby authorized to enter into an Agreement with SIXMO Company to provide construction <br />management services for the Senior Center and Community Cabin Kitchen Renovation Project. <br />Said Agreement shall be in the form and substance as on file in the Department of Recreation <br />and Public Engagement, with such changes in form and substance that are not substantially <br />adverse to the City and which are approved by the Director of Law. The character of the <br />agreement as not being substantially adverse to the City shall be evidenced conclusively by the <br />execution of the agreement by the Mayor and the approval of the contract by the Director of <br />Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the public health, safety and welfare to retain services to assist with <br />the competing bidding currently scheduled for opening on May 12, 2023; and further provided it <br />receives the affirmative vote of two thirds of the members of Council, it shall take effect upon its <br />approval by the Mayor. <br />PASSED.-/ jAq q 9&{ -3 First Reading: <br />U Second Reading.- <br />Third Reading: Sits St <br />Committee: <br />
