CITY OF NORTH OLMSTED ORDINANCE NO. 2023 - 18 By: Mayor Jones AN ORDINANCE AMENDING SECTION 1118.13 OF THE PLANNING AND ZONING CODE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED ENTITLED, "OFFICES AND SERVICES", IN ORDER TO LIMIT THE LOCATION OFSPECIFIED USES. WHEREAS, upon review, the Director of Economic and Community Development recommends this Council consider amending Section 1118.13 (C) in order to condition and limit the establishment of specified uses within 2,500 feet of Places of Worship, Parks, Schools or Daycare Facilities; and WHEREAS, following publication of newspaper notice in conformance with the provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a public hearing was held on the4'^ day of April . 2023; and WHEREAS, after careful consideration, the Planning and Design Commission of the City, on the 22nd day of March '2023, by formal motion, recommended that this Ordinance amending Section 1118 of the Zoning Code, presently entitled "Offices and Services" be (approved) (disapproved); and WHEREAS, it is the desire of this Council to amend Planning and Zoning Code Section 1118.13 (C) as recommended by the Planning and Design Commission, in order to add spatial limitations to the Zoning Code as set forth in the Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTHOLMSTED, CUYAHOGA COUNTY, AND STATE OFOHIO: SECTION 1: That Chapter 1118.13 "Offices and Services" which reads in its entirety as follows: 1118.13 OFFICES AND SERVICES. A. Animal Services, Veterinary Office/Clinic, Animal Hospital, Grooming, Boarding, Training or Day Care. 1. No part of the facility shall be located closer than 100 feet from any residential zoning district. 2. If the facility is to include outdoor runs or exercise areas, minimum lot area shall be one (1) acre. 3. No dog runs or animal exercise areas shall be located in a front yard.
