NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OFCUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Service Director or Mayor be and they are hereby retroactively <br />authorized to contract, through the State Purchasing Program, which was established by R.C. <br />Section 125.04, and which the City is authorized to participate in pursuant to the City Charter <br />and Resolution No. 87-6, the purchase of a CrackPro 125DA, and related equipment, at a total <br />cost of Sixty -Nine Thousand Six Hundred and Thirty -Eight Dollars and Thirty -Nine Cents <br />($69,638.39), from Thorworks Industries, Inc. Further, as may be necessary to effectuate any <br />such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute <br />any contract documents required by the authorized vendor(s), the State of Ohio, or the Charter. <br />SECTION 2: That the Council of the City of North Olmsted, pursuant to Section <br />5705.41(D)(1) of the Ohio Revised Code, hereby approves the execution of Then and Now <br />Certificates by the Finance Director and authorizes payments due and owing. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately to ratify the <br />purchase; and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: a0 <br />ATTEST: <br />BEATRICE TAYLOR <br />Clerk of Council <br />APPROVED: <br />MAYOR NICOLE DAILEr J NES <br />First Reading: -?—/--13 <br />Second Reading: 7—IS -c,73 <br />Third Reading: , iSr m an <br />Committee: aw . n # l <br />L?QLWSJ BROSSARD <br />President of Council <br />APPROVED AS TO LEGAL FORM - <br />Al Michael R.
