NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OFCUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Service Director or Mayor be and they are hereby retroactively authorized to contract, through the State Purchasing Program, which was established by R.C. Section 125.04, and which the City is authorized to participate in pursuant to the City Charter and Resolution No. 87-6, the purchase of a CrackPro 125DA, and related equipment, at a total cost of Sixty -Nine Thousand Six Hundred and Thirty -Eight Dollars and Thirty -Nine Cents ($69,638.39), from Thorworks Industries, Inc. Further, as may be necessary to effectuate any such purchase through the State Purchasing Program, the Mayor is hereby authorized to execute any contract documents required by the authorized vendor(s), the State of Ohio, or the Charter. SECTION 2: That the Council of the City of North Olmsted, pursuant to Section 5705.41(D)(1) of the Ohio Revised Code, hereby approves the execution of Then and Now Certificates by the Finance Director and authorizes payments due and owing. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Ordinance go into effect immediately to ratify the purchase; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
