CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 —110 <br />By: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH CUYAHOGA COUNTY AND THE CUYAHOGA <br />COUNTY COURT OF COMMON PLEAS, JUVENILE DIVISION, <br />WHEREIN THE CITY WILL CONTINUE TO IMPLEMENT A <br />COMMUNITY DIVERSION PROGRAM TO HEAR STATUS, <br />MISDEMEANOR, OR FELONY OFFENSE COMPLAINTS INVOLVING <br />JUVENILES THROUGH DECEMBER 31, 2024, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, for several years the City of North Olmsted has successfully operated youth <br />and community diversion programs, including those in cooperation with the Court, and with the <br />objective to prevent, control and rehabilitate juvenile delinquency; and <br />WHEREAS, this Council desires to enter into an Agreement with Cuyahoga County, and <br />the Cuyahoga County Court of Common Pleas, Juvenile Division, to participate in the Juvenile <br />Court's Community Diversion Program to hear status, misdemeanor, or felony offense <br />complaints charging juvenile offenders with such offenses; and <br />WHEREAS, the County and the Juvenile Court have recently proposed the attached <br />Agreement, which contains a one (1) year term from January 1, 2024 to December 31, 2024, and <br />contains a stipend for the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and she is hereby authorized to enter into an <br />Agreement with Cuyahoga County and the Cuyahoga County Court of Common Pleas, Juvenile <br />Division, to participate in the Court's Community Diversion Program for charged juvenile status, <br />misdemeanor, or felony offenses and to receive financial assistance in connection with a <br />Community Diversion Program sponsored by the Cuyahoga County Juvenile Court for the period <br />of January 1, 2024 to December 31, 2024. Said contract shall be substantially in the form of the <br />"Community Diversion Program Agreement," marked as Exhibit "A" and attached hereto. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately and prior to the <br />expiration of the current contract on December 31, 2023; and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
