CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2023 - 109 <br />By: Mayor Jones <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO <br />CREATE THE FEDERAL EQUITABLE SHARING FUND TO TRACKBOTH <br />REVENUE AND EXPENDITURES FOR THE UNITED STATES <br />DEPARTMENTOF.IIISTICEAND THE UNITEDSTATESDEPARTMENTOF <br />TREASURY EQUITABLE SHARING FUNDS OR TANGIBLE PROPERTY <br />DISBURSED TO THE CITY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Ohio Revised Code Section 5705.09(F) requires the City to establish a special <br />fund for each class of revenue derived from a special source other than general property tax which <br />the law requires to be used for a particular purpose; and <br />WHEREAS, any state, local, or tribal law enforcement agency that is a participant in the <br />Equitable Sharing Program and directly participates in an investigation or prosecution resulting in a <br />federal forfeiture may request an equitable share of the net proceeds of the forfeiture; and <br />WHEREAS, the Federal Equitable Sharing Fund would be a special revenue fund to account <br />for the revenues received from the U.S. Department of Justice and the U.S. Department of Treasury <br />and to properly account for law enforcement expenditures as allowed under the Equitable Sharing <br />Program; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Finance to create the <br />Federal Equitable Sharing fund. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTYOF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Finance be and she is hereby authorized to create the <br />Federal Equitable Sharing Fund. <br />SECTION 2: That this Resolution is hereby declared to he an emergency measure <br />immediately necessary for the preservation ofthe public health, safety and welfare and for the further <br />reason that it is necessary that this legislation go into effect immediately in order to meet the State <br />guidelines; and further provided that it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: I ki{; p Y117 <br />ATTEST: <br />First Reading: <br />Second Reading. /b `��7,,—�•,,�/ �i <br />Third Reading: <br />Committee: a A -h <br />[t.i <br />
