CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 -107 <br />By: Mayor Jones <br />AN ORDINANCE ACCEPTING A 0.0073 ACRE PERMANENT <br />RIGHT-OF-WAY EASEMENT ACQUIRED FOR A PUBLIC <br />PURPOSE, TO WIT: THE ESTABLISHMENT, CONSTRUCTION, <br />RECONSTRUCTION, WIDENING, REPAIR OR MAINTENANCE OF <br />CLAGUE ROAD, FROM CARSON WASSERBECK AKA CARSON <br />LEE WASSERBECK AND LORI A. WASSERBECK ON PROPERTY <br />KNOWN AS PERMANENT PARCEL NUMBER 237-70-005, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted is preparing to undertake the establishment, <br />construction, reconstruction, widening, repair or maintenance (hereinafter collectively "Project") <br />of Clague Road; and <br />WHEREAS, in planning for undertaking the Project, it was determined by the City that <br />0.0073 acres of real estate on PPN 231-10-005 (hereinafter "the Property") were needed to widen <br />the intersection of Clague Road at its intersection with Maple Ridge Road; and <br />WHEREAS, the City appraised the Property and then negotiated with Carson <br />Wasserbeck (aka Carson Lee Wasserbeck) and Lori A. Wasserbeck (hereinafter collectively the <br />"Wasserbecks") to acquire a 0.0073 acre easement on the Property; and <br />WHEREAS, the Wasserbecks and the City of North Olmsted successfully negotiated an <br />Easement, a copy of which is attached hereto as Exhibit A; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of the <br />Director of Law and the City Engineer, to accept the easement and to provide for the recording of <br />such conveyance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. <br />SECTION 1: It is determined by this Council that the property to be conveyed and <br />identified in the Permanent Easement attached as Exhibit A hereto, is acquired by the City of <br />North Olmsted for a valid public purpose namely, the establishment, construction, <br />reconstruction, widening, repair or maintenance of Clague Road; and <br />SECTION 2: That the Mayor is hereby authorized and directed to accept, on behalf of <br />the City of North Olmsted, a Permanent Easement from the Wasserbecks, the owners of PPN <br />231-10-005, as further described within said document, marked as Exhibit A attached hereto and <br />incorporated herein by reference. <br />
