CITY OF NORTH OLMSTED ORDINANCE NO. 2023 - 106 By: Mayor Jones AN ORDINANCE ACCEPTING A 0.0048 ACRE PERMANENT RIGHT-OF-WAY EASEMENT ACQUIRED FOR A PUBLIC PURPOSE, TO WIT: THE ESTABLISHMENT, CONSTRUCTION, RECONSTRUCTION, WIDENING, REPAIR OR MAINTENANCE OF CLAGUE ROAD, FROM KYLE WELLS AND KATHRYN WELLS ON PROPERTY KNOWN AS PERMANENT PARCEL NUMBER 231-10- 068, AND DECLARINGANEMERGENCK WHEREAS, the City of North Olmsted is preparing to undertake the establishment, construction, reconstruction, widening, repair or maintenance (hereinafter collectively "Projeef') of Clague Road; and WHEREAS, in planning for undertaking the Project, it was determined by the City that 0.0048 acres of real estate on PPN 231-10-068 (hereinafter "the Property") were needed to widen the intersection of Clague Road at its intersection with Maple Ridge Road; and WHEREAS, the City appraised the Property and then negotiated with Kyle Wells and Kathryn Wells (hereinafter collectively the "Wells") to acquire a 0.0048 acre easement on the Property; and WHEREAS, the Wells and the City of North Olmsted successfully negotiated an Easement, a copy of which is attached hereto as Exhibit A; and WHEREAS, it is the desire of this Council, upon the advice and recommendation of the Director of Law and the City Engineer, to accept the easement and to provide for the recording of such conveyance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. SECTION 1: It is determined by this Council that the property to be conveyed and identified in the Permanent Easement attached as Exhibit A hereto, is acquired by the City of North Olmsted for a valid public purpose namely, the establishment, construction, reconstruction, widening, repair or maintenance of Clague Road; and SECTION 2: That the Mayor is hereby authorized and directed to accept, on behalf of the City of North Olmsted, a Permanent Easement from the Wells, the owners of PPN 231-10- 068, as further described within said document, marked as Exhibit A attached hereto and incorporated herein by reference.
