CITY OF NORTH OLMSTED RESOLUTION NO. 2023 - 123 By: Mayor Jones A RESOL UTION A UTHORIZING THE MAYOR TO CONTRACT FOR THE PURCHASE OF 25 PORTABLE RADIOS FROM MOTOROLA SOLUTIONS, AT A COST OF $116,649.00, AS PRICED THROUGH THE STATE PURCHASE PROGRAM AND REQUIRED BY THE STATE OF OHIO'S MARCS' RADIO NETWORK FOR DEPLOYMENT BY NORTH OLMSTED POLICE DEPARTMENT,• AND FURTHER AUTHORIZING THE MAYOR TO EXECUTE ALL CONTRACT DOCUMENTS, AND DECLARING AN EMERGENCY. WHEREAS, the Director of Public Safety and the Chief of Police have recommended, in order to comply with security requirements issued by the State of Ohio, MARCS Radio Network, that the Council authorize the purchase of twenty-five (25) portable radios from Motorola Solutions at a cost of $116,649.00; and WHEREAS, the purchase of said radios, although in excess of Fifty Thousand Dollars ($50,000), is not legally required by the City Charter to be competitively bid because the pricing is established by the State Purchase Program, which is an exception from public bidding recognized by the City Charter; and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into a contract for the purchase of twenty-five (25) portable radios from Motorola Solutions at a cost of $116,649.00 for use by the NOPD and further to authorize the Mayor to execute all documents necessary to effectuate said purchase. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and she is hereby authorized to purchase, through the State Purchasing Program, which was established by R.C. §125.04 and which the City is authorized to participate in pursuant to Ordinance No. 87-6 and the City Charter: Twenty-five (25) Motorola Solutions Portable Radios at a cost of $116,649.00 from Motorola. SECTION 2: The Mayor is hereby authorized to execute any contract and/or other appropriate documents required by the authorized vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor shall be in a form and substance consistent with the provisions of this Resolution and approved by the Director of Law.
