CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 -95 <br />By: Mayor Jones <br />AN ORDINANCE AMENDING THE ZONING MAP OF THE CITY OF <br />NORTH OLMSTED TO REZONE A PORTION OF SPLIT PARCEL <br />233-26-063 FROM ONE FAMILY RESIDENCE TO B-3 GENERAL <br />BUSINESS ZONING, ASAMENDED. <br />WHEREAS, the City of North Olmsted acquired Parcel Nos. 233-26-063, 064, and 065, <br />(commonly known as Forest Elementary School on Tudor Drive) from the North Olmsted Board <br />of Education for the purpose of economic development; and <br />WHEREAS, the Director of Economic and Community Development has negotiated with <br />the owner of Weber Automotive, located at 28820 Lorain Road, a proposal to split a portion of <br />Parcel 233-26-063, in order to enter into an agreement to split the parcel and sell the southerly <br />portion of said real estate to Weber Automotive for the purposes of expansion of its business <br />operations, subject to the approval of this Council and further subject to the Council's approval <br />of rezoning for same; and <br />WHEREAS, the Director of Economic and Community Development further <br />recommends, conditioned upon the Council's approval of the said real estate purchase <br />agreement, to rezone the split portion of Parcel 233-26-063 from its current B One Family <br />Residence to B-3 General Business commercial zoning in order to accommodate the business <br />expansion of Weber Automotive; and <br />WHEREAS, following duly noticed public hearing pursuant to and in conformance with <br />the provisions of Section 2(d) of Article VII of the Charter and Section 1127.02, the Planning <br />and Design Commission, considered and voted to recommend (not recommend) approva of this <br />Qrdinance to change the Zone Map and rezone a portion of Parcel 233-26-063 on y of <br />2023; and <br />WHEREAS, following publication of newspaper notice and notice to the record title <br />holders of real property located within one thousand (1,000) feet of the property proposed to be <br />rezoned, a public hearing was held, in conformance with the provisions of Sectionf rcle <br />IV of the Charter and Section 1127.03 of the Zoning Code, on the /J* day of 4 rt , <br />2023; <br />WHEREAS, it is the desire of this Council to amend the Zoning Code and to specially <br />rezone the split portion of Parcel 233-26-063, all as recommended by the Planning and Design <br />Commission, in order to promote economic development and conditioned upon Council's <br />independent approval of a real estate purchase agreement with Weber Automotive. <br />
