CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2023 - 129 <br />By: Mayor Jones <br />AN ORDINANCE ACCEPTING A 0.0006 ACRE PERMANENT <br />RIGHT-OF-WAY EASEMENT ACQUIRED FOR A PUBLIC <br />PURPOSE, TO WIT: THE ESTABLISHMENT, CONSTRUCTION, <br />RECONSTRUCTION, WIDENING, REPAIR OR MAINTENANCE OF <br />CLAGUE ROAD, FROM RICHARD T. BARBER, 11, ON PROPERTY <br />KNOWN AS PERMANENT PARCEL NUMBER 231-24-014, AND <br />DECLARINGAN EMERGENCY. <br />WHEREAS, the City of North Olmsted is preparing to undertake the establishment, <br />construction, reconstruction, widening, repair or maintenance (hereinafter collectively "Project') <br />of Clague Road; and <br />WHEREAS, in planning for undertaking the Project, it was determined by the City that <br />0.0006 acres of real estate on PPN 231-24-014 (hereinafter "the Property") were needed to widen <br />the intersection of Clague Road at its intersection with Frank Street; and <br />WHEREAS, the City appraised the Property and then negotiated with Richard T. Barber, <br />H, (hereinafter "Barber") to acquire a 0.0006 acre easement on the Property; and <br />WHEREAS, Barber and the City of North Ohnsted successfully negotiated an Easement, <br />a copy of which is attached hereto as Exhibit A; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of the <br />Director of Law and the City Engineer, to accept the easement and to provide for the recording of <br />such conveyance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO. <br />SECTION 1: It is determined by this Council that the property to be conveyed and <br />identified in the Permanent Easement attached as Exhibit A hereto, is acquired by the City of <br />North Olmsted for a valid public purpose namely, the establishment, construction, <br />reconstruction, widening, repair or maintenance of Clague Road. <br />SECTION 2: That the Mayor is hereby authorized and directed to accept, on behalf of <br />the City of North Olmsted, a Permanent Easement from Barber, the owner of PPN 231-24-014, <br />as further described within said document, marked as Exhibit A attached hereto and incorporated <br />herein by reference. <br />
