CITY OF NORTH OLMSTED ORDINANCE NO. 2024 - 18 By: Mayor Jones AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE DOCUMENTS REQUIRED TO GRANT SEPARATION OF AN IDENTIFIED AREA FROM THE NORTH OLMSTED SEWER FACILITY PLANNING AREA TO THE NORTHEAST OHIO REGIONAL SEWER DISTRICT FACILITY PLANNING AREA AND, ONCE APPROVED, TO ENTER INTO AN AMENDMENT OF THE SEWER SERVICE AREA DEFINED BY THE SEWER SERVICE AGREEMENT WITH THE COUNTY OF CUYAHOGA, AS AMENDED AND RESTATED IN 2013, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted previously negotiated amendment of and restated its Sewer Service Agreement with Cuyahoga County (dated 10/23/13), pursuant to authorization granted by Council by Ordinance 2013-88, in conjunction with capital improvements to the Wastewater Treatment Plant ("W WTP") serving a portion of County's Sewer District No. 14; and WHEREAS, the Cuyahoga County Department of Public Works ("CCDPW') approached the City of North Olmsted with a request to change the Facilities Planning Area ("FPA") for the sewage treatment of a certain area of Fitch Rd. in Olmsted Township; and WHEREAS, the FPA amendment request summary from NOACA, along with a map of the area that is being transferred from North Ohnsted to the North East Ohio Regional Sewer District (Collectively Exhibit A) is attached hereto and incorporated herein; and WHEREAS, the area in question is along Fitch Road from Southwood Lane heading south to the high voltage lines, encompassing 70.93 acres with 36 parcels; and WHEREAS, the City does not currently have sewers in this area and has not formulated a plan as of this date to include them in the future. WHEREAS, this Council has determined to approve the further amendment of the Facilities Planning Area within the Sewer Service Agreement, as Amended and Restated in 2013, in order to decrease the service area as shown in revised Exhibit A. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: The Mayor and other City officers are authorized to execute all documents consenting to the FPA modification as identified in Exhibit A. Once approved by NOACA, the Mayor is further authorized and directed to sign and deliver, in the name of and on behalf of the City and in their official capacities, an Amended and Restated Sewer Service Agreement between the City and Cuyahoga County.
