CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2024 — 22 <br />By: Mayor Jones <br />AN ORDINANCE DESIGNATING REVENUE DERIVED FROM THE <br />LEASE OF A SITE FOR THE ESTABLISHMENT OF A CELLULAR <br />TOWER AT THE NORTH OLMSTED PARK, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Ordinance 97-74 first designated revenue from a cellular tower on City <br />property at Clague Park to be split between the Economic Development Fund (25%) and the <br />Recreation Fund (75%); and <br />WHEREAS, Ordinance 2002-48 expanded upon Ordinance 97-74 by designating revenue <br />received from co -locators on the cellular tower at Clague Park; and <br />WHEREAS, Ordinance 2005-75 provided as follows: <br />Effective June 7, 2005, all revenues received by the City upon and after said date <br />in connection with any lease or sublease of any City -owned property for use as a <br />telecommunication facility shall be designated as follows: (a) seventy-five percent <br />(75%) to the Recreation Fund and twenty-five (25%) to the Economic <br />Development Fund; and <br />WHEREAS, the City has entered into a lease for the establishment of a cellular tower site <br />at North Olmsted Park and the Administration desires that one hundred percent (100%) of the <br />revenue from the ground lease for said cellular tower be allocated to the Recreation Fund to be <br />used for the North Olmsted Park Improvement Project and related park improvements. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTYOF CUYAHOGA, AND STATE OF OHIO. <br />SECTION 1: That the provisions of Ord. 2005-75, which shall remain in effect, shall <br />not be applicable to revenue generated for the City from a ground lease for the establishment of a <br />cellular tower at North Olmsted Park. The Ordinance shall still apply to subleases and revenues <br />generated from co -locators on the tower; and <br />SECTION 2: That one hundred percent (1000/6) of the revenue from the ground lease <br />related to the cellular tower at North Olmsted Park be and the same we hereby allocated to the <br />Recreation Fund to be used for the North Olmsted Park Improvement Project and related park <br />improvements. <br />
