CITY OF NORTH OLMSTED ORDINANCE NO. 2024 - 35 BY: Mayor Jones AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A FIRST AMENDMENT TO THE AGREEMENT BETWEEN THE COUNTY OF CUYAHOGA AND THE CITY OF NORTH OLMSTED FOR THE RESURFACING OF CLAGUE ROAD FROM LORAIN ROAD TO MARIONROAD, AND DECLARINGAN EMERGENCY. WHEREAS, this Council, by and through Ordinance No. 2020-83, authorized the City of North Olmsted, as the MUNICIPALITY, to enter into an Agreement with Cuyahoga County, as the COUNTY, for the resurfacing of Clague Road from Lorain Road to Marion Road, a copy of which is attached as Exhibit A; and WHEREAS, the parties propose to amend Section C (5) in order to provide for the COUNTY to take responsibility for fifty percent (50%) of the Non -Federal Share, up to $600,000.00, and the MUNICIPALITY will be responsible for the remaining Non -Federal Share of the cost of construction. The COUNTY shall further be responsible for One Hundred percent (100%) of the Non -Federal Share of the cost of construction supervision; and WHEREAS, it is the desire of this Council to authorize the Mayor to sign, on behalf of the City of North Olmsted, a First Amendment to the Agreement between the COUNTY and the MUNICIPALITY for the resurfacing of Clague Road from Lorain Road to Marion Road, a copy of which is attached as Exhibit B. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTYOF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and she is hereby authorized, on behalf of the City of North Olmsted, to enter into a First Amendment to the Agreement between Cuyahoga County and the City of North Olmsted for the Resurfacing of Clague Road between Lorain Road and Marion Road, pursuant to attached Agreement form with the County, attached as Exhibit B. SECTION 2: Except as amended herein, Ordinance No. 2020-83 is incorporated herein in by reference as if fully rewritten herein, together with the Agreement between the COUNTY and MUNCIPALITY, dated 2/8/22, for the resurfacing of Clague Road from Lorain Road to Marion Road, a copy of which is attached as Exhibit A. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Ordinance go into effect immediately so as to enable County funding for Clague Road resurfacing as described herein, and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
