CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2024 - 28 <br />By: Mayor Jones <br />AN ORDINANCE AMENDING SECTION 1101.02 ENTITLED <br />"MAJOR SUBDIVISIONS, PROCEDURAL REQUIREMENTS" OF <br />CHAPTER 1101 OF THE PLANNING AND ZONING CODE OF THE <br />CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED <br />ENTITLED SUBDIVISION REGULATIONS" IN ORDER TO <br />ELIMINATE THE STREET LENGTH PROVISION WHEN A CUL <br />DE -SAC IS PLANNED AS SET FORTH IN SECTION <br />1101.02(D)(2)(E), ASAMENDED. <br />WHEREAS, Chapter 1101.02 permits the use of a cul-de-sac when a continuous street <br />cannot be fitted into the overall street plan and the street is less than 500 feet in length; and <br />WHEREAS, the Director of Economic and Community Development proposes to remove <br />the street length requirements for cul-de-sac usage; and <br />WHEREAS, after careful consideration, the Planning and Design Commission of the <br />City, on the 4" day of April, 2024, by formal motion, recommended that this Ordinance <br />amending Section 1101.02 of the Zoning Code, entitled "Major subdivisions; Procedural <br />Requirements" be (approved) (disapproved) by City Council; and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Planning and <br />Zoning Code, a public hearing was held on the 21 st day of May, 2024; and <br />WHEREAS, it is the desire of this Council to amend the Planning and Zoning Code, as <br />recommended by the Director of Economic and Community Development, in order to amend the <br />cul-de-sac provision as set forth in Section 1101.02(d)(12)(E). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. <br />SECTION 1: That Section 1101.02 "Major Subdivisions; Procedural Requirements" of <br />the North Olmsted Planning and Zoning Code, which reads in its entirety as set forth on Exhibit A, <br />be amended and as amended shall read as set forth on Exhibit A, with such amendments identified <br />by boldface and / or stricken text. <br />
