This Agreement is made between the City of North Olmsted (hereinafter referred to as the <br />("Employee'), and the Fraternal Order of Police/Ohio Labor Council (hereinafter referred to as the <br />"FOP"). <br />The purpose of this Agreement is to provide a fair and reasonable method of enabling employees <br />covered by this Agreement to participate, through representation, in the establishment of terms and <br />conditions of their employment, and to establish a peaceful procedure for the resolution of <br />differences between the parties. <br />ARTICLE 1 <br />RECOGNITION <br />1.01. Included. The Employer recognizes the FOP as the sole and exclusive bargaining <br />representative for all full-time sworn employees of the Employer comprising two (2) bargaining <br />units, with one (1) bargaining unit including all full-time patrolmen and one (I) bargaining unit <br />including all full-time sergeants and lieutenants, analuding the Chief sf Pakee for the purpose of <br />collective bargaining with respect to wages, hours, terms, and other conditions of employment. <br />1.02. Excluded. The Chief of Police, Captains, and all other employees not specifically included <br />in Section 1.01 shall be excluded from the bargaining unit. <br />ARTICLE 2 <br />BARGAEVEVG UNIT WORKIEXTRA DUTY <br />444 2.01. Barrainine Unit Work. Management shall not attempt to erode the bargaining units <br />or the rights of bargaining unit employees. Except in emergency circumstances, work normally <br />performed by bargaining unit members shall first be offered to bargaining unit members. <br />2.02. City -Paid Extra Duty Details. This kriiele shall else apply to special duty or special <br />assignments which may be compensated through the Employer resulting from requests by private <br />individuals or groups for security or traffic control. <br />ARTICLE 4 3 <br />a.44- 3.01. Federal/State Discrimination Alleeations. Both the Employer and the FOP recognize <br />their respective responsibilities under the Federal and State Civil Rights Laws, Fair Employment <br />Practices Acts, and other similar constitutional and statutory requirements. The parties recognize and acknowledge that any allegation of discrimination based <br />on a legally protected classification under Federal or State law shall be processed through <br />external administrative agencies (Le., EEOCOCRC). <br />3:9a 3.02. Union Affiliation.
