CITY OF NORTH OLMSTED, OHIO <br />ORDINANCE NO. 2024 - 67 <br />BY: Mayor Jones <br />AN ORDINANCE DECLARING AN ADDITIONAL FORTY- FIVE (45) DAY <br />MORATORIUM, THEREBY EXTENDING THE MORATORIUM <br />APPROVED BY ORDINANCE 2024-11, RESTRICTING THE ISSUANCE OF <br />ANY PERMITS, ZONING OR OTHERWISE, TO ANY BUSINESS <br />OPERATING AS A THRIFT STORE IN ORDER TO ALLOW FOR SUCH A <br />RETAIL USE TO BE PROPERLY DEFINED IN SECTION 1115 OF THE <br />ZONING CODE AND ADDED TO THE USE TABLE IN CHAPTER 1139 OF <br />THE BUSINESS CODE AND OTHERWISE REGULATED IN THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, by and through Ordinance No. 2024-11, effective February 6, 2024, this <br />Council adopted a 180 -day Moratorium on the issuance of permits for retail Thrift Stores, the <br />terms and conditions of which are incorporated by reference; and <br />WHEREAS, Ordinance Nos. 2024-51, Ordinance No. 2024-52, and Ordinance No. 2024- <br />53, were introduced on May 21, 2024, and pending review before this Council to address Thrift <br />Store regulations, and such review is not scheduled to be completed within the 180 -day <br />Moratorium; and <br />WHEREAS, this Council finds and determines that an additional forty-five day extension <br />of the 180 -day Moratorium imposed by Ordinance No. 2024-11 is warranted on the issuance of <br />permits, building permits and/or licenses under Title Three of the Planning and Zoning Code of <br />the Codified Ordinances of North Olmsted, Ohio, or any other provision of the Codified <br />Ordinances of the City of North Olmsted for the development, construction, use, or occupancy of <br />any establishment designed or intended to be used in whole or in part as a thrift shop or thrift <br />store is reasonable and necessary. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: For purpose of this Ordinance, "Thrift Store" or "Thrift Shop" shall <br />include any person (real or corporate) engaged in any business of selling, exchanging or <br />receiving used goods, products or merchandise from a commercial storefront premises and/or <br />warehoused in storage facilities. For purpose of this Ordinance, "used" means previously owned, <br />secondhand, or not "new" as when offered for sale by the original manufacturer and/or <br />distributor. <br />SECTION 2: For the reasons stated in the preamble of this Ordinance, this Council <br />adopts and incorporates by reference the 180 -day moratorium imposed by Ordinance No. 2024- <br />11, effective February 6, 2024, and hereby further declares and imposes an extension of said <br />moratorium for an additional forty-five days from August 4, 2024 until September 18, 2024. <br />
