MINUTES OF THE PUBLIC HEARING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />AUGUST 6, 2024 <br />Present: Council President Brossard, Council Members Gilchrist, Glassburn, <br />Hemann, Limpert, Madden, Scarl and Shymske. <br />Also Present: Mayor Jones, Director of Law Gareau, Finance Director Copfer, Director <br />of Safety Scofield, Director of Human Resources Kidd, Service Director <br />Kearney, and Special Assistant to the Mayor. <br />Absent: None. <br />Council President Brossard called the meeting to order at 7:05 p.m., and reminded <br />Council that their role at the Public Hearing is to listen to comments from the speakers, <br />noting that any questions can be addressed at a committee meeting to be scheduled in <br />the near future. <br />ISSUE: Ordinance 2024-73 - An Ordinance establishing the definition of "Vape <br />Shop" in Section 1115.12 of the Planning and Zoning Code of the Codified <br />Ordinances of the City of North Olmsted entitled, "Definitions U -V", for the <br />purpose of adding definitions for uses associated with retail sales by vape shops. <br />The Safety Director explained that Ordinance 2024-73 aims to provide a clearer <br />definition of what constitutes a vape shop. The change aligns with updates to the <br />business code and helps regulate unregulated psychoactive substances that can cause <br />hallucinations or changes in alertness. The ordinance specifies that any retail or service <br />establishment that devotes at least 51% of its floor area to selling or displaying <br />electronic cigarettes, vapor products, or alternative nicotine products, or allows vaping <br />on site, qualifies as a vape shop, noting that this clarification will enhance the <br />enforcement of business zoning codes. <br />IMT;n <br />At 7:10 p.m., the next issue was read by the Clerk: <br />ISSUE: Ordinance 2024-62 - An Ordinance creating and adopting new Chapter <br />1157 of the North Olmsted Zoning Code entitled 'Planned Development' to <br />establish a new zoning district and to regulate development plans for the <br />construction of new residential housing. <br />
