CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2024 - 89 <br />BY: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE CITY OF NORTH OLMSTED, <br />PURSUANT TO SECTION 941.01(d) OF THE STREETS, UTILITIES AND <br />PUBLIC SERVICES CODE, TO PARTIALLY CONTRIBUTE TO THE <br />COSTS INCURRED FOR REFUSE COLLECTION BY OWNERS OF <br />CERTAIN RESIDENTIAL STRUCTURES NOT OTHERWISE <br />AUTHORIZED TO RECEIVE REFUSE COLLECTION SERVICES FROM <br />THE CITY OFNORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, in the spring of 2011 the City of North Ohnsted phased in a new and revised <br />system of refuse collection by and through the use of automated collection and, consequently, <br />this Council adopted revised standards for refuse collection in Chapter 941 (Ord. 2012-5); and <br />WHEREAS, Ord. 2022-79 was adopted by the City Council amending Chapter 941.01(d) <br />by authorizing the City of North Olmsted to contribute an agreed-upon sum toward the cost of <br />refuse pick-up service for residential structures on non -dedicated streets and not otherwise <br />entitled to collection services from the City, when said residential structures are otherwise in <br />compliance with the provisions of Chapter 941 as it regulates residential structures on "dedicated <br />streets'; and <br />WHEREAS, pursuant to and in accordance with Section 941.01(d), this Council via Ord. <br />2022-121 authorized the City of North Olmsted to partially contribute twenty—five percent (25%) <br />of the costs incurred for refuse collection by owners of certain residential structures not <br />otherwise authorized to receive refuse collection; and <br />WHEREAS, pursuant to Ord. 2023-127, this Council again authorized the City of North <br />Olmsted in 2024 to partially contribute an amount not to exceed fifty percent (50%) of the costs <br />incurred for refuse collection by owners of certain residential structures not otherwise authorized <br />to receive refuse collection; and <br />WHEREAS, the Administration and this Council wish for the City of North Olmsted to <br />again increase participation in costs by paying seventy-five percent (75%) of the cost of refuse <br />collection for residential structures on non -dedicated streets, but that are otherwise in compliance <br />with the provisions of Chapter 941, in the yew 2025. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO. <br />SECTION 1: That the Mayor be and she is hereby authorized on behalf of the City of <br />North Olmsted to enter into an Agreement with Republic Services to contribute a sum not to <br />exceed seventy-five percent (75%) of the cost of refuse collection from January 1, 2025 through <br />December 31, 2025 for residential structures only located on the following non -dedicated streets <br />that are otherwise in compliance with the provisions of Chapter 941: <br />
