CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2024 — 99 <br />By: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AMENDED AGREEMENT WITH CUYAHOGA COUNTY AND THE <br />CUYAHOGA COUNTY COURT OF COMMON PLEAS, JUVENILE <br />DIVISION, WHEREIN THE CITY WILL CONTINUE TO IMPLEMENT A <br />COMMUNITY DIVERSION PROGRAM TO HEAR STATUS, <br />MISDEMEANOR, OR FELONY OFFENSE COMPLAINTS INVOLVING <br />JUVENILES, FROM DECEMBER 31, 2014 THROUGH DECEMBER 31, <br />2026, AND DECLARINGANEMERGENCY. <br />WHEREAS, for several years the City of North Olmsted has successfully operated youth <br />and community diversion programs, including those in cooperation with the Court, and with the <br />objective to prevent, control and rehabilitate juvenile offenders; and <br />WHEREAS, this Council desires to enter into an Amendment of the Agreement with <br />Cuyahoga County, and the Cuyahoga County Court of Common Pleas, Juvenile Division, to <br />participate in the Juvenile Court's Community Diversion Program to hear status, misdemeanor, <br />or felony offense complaints charging juvenile offenders with such offenses; and <br />WHEREAS, the County and the Juvenile Court have recently proposed the attached <br />Amendment to the Agreement, which contains a two (2) year term from December 31, 2024 to <br />December 31, 2026, and contains an increase of the stipend for the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and she is hereby authorized to enter into an <br />Amendment of the Agreement with Cuyahoga County and the Cuyahoga County Court of <br />Common Pleas, Juvenile Division, to participate in the Court's Community Diversion Program <br />for charged juvenile status, misdemeanor, or felony offenses and to receive financial assistance in <br />connection with a Community Diversion Program sponsored by the Cuyahoga County Juvenile <br />Court for the period of December 31, 2024 to December 31, 2026. Said contract shall be <br />substantially in the form of the "Amendment to the Community Diversion Program Agreement," <br />marked as Exhibit "A" and attached hereto. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately in order to be in <br />effect prior to the expiration of the current contract on December 31, 2024 and additionally in <br />order to meet an October 7, 2024 deadline; and further provided it receives the affirmative vote <br />
