EXHIBIT A <br />. 161.11 ACCUMULATED VACATION LEAVE. <br />(a) "Accumulated vacation leave" means days of earned vacation leave which an employee does <br />not use during the one-year period following the one-year period of full-time employment in <br />which the days were earned. <br />(b) Non -bargaining unit employees who have accumulated vacation leave shall be permitted to <br />carry over accumulated vacation leave from one one-year period to the following one-year <br />provided that: <br />(1) Written notice is made to the employee's immediate supervisor prior to the end of the <br />one-year period immediately following the one-year period in which the vacation leave was <br />earned; and <br />(2) The employee's immediate supervisor verifies that the accumulated vacation leave is <br />available to the employee. <br />(c) Notwithstanding paragraphs (b)(l) and (2) herein, no employee shall be permitted to carry <br />over mora days of accumulated vacation leave into a succeeding one-year period than he or she <br />earned in the immediately preceding one-year period. <br />(d) In lieu of carrying over accumulated vacation leave into a succeeding one-year period, non - <br />bargaining unit employees who have accumulated vacation leave, which may be carried, <br />pursuant to paragraphs (b) or (c) above, into a succeeding year, shall be permitted to elect to <br />receive payment for some or all of said accumulated vacation leave provided that: <br />(1) Written notice is given to the employee's immediate supervisor prior to the end of the <br />one-year period immediately following the one-year period in which the vacation leave was <br />earned; and <br />(2) Said immediate supervisor approves. <br />However, no such employee shall be entitled to apply for or receive payment for any of his or <br />her accumulated vacation leave in any year in which he or she has not taken off at least five <br />workdays, unless the Mayor determines that, due to emergency or other exigent circumstances <br />beyond the control of the employee, the employee was unable to take off five workdays. <br />(e) Payment for accumulated vacation leave shall be based upon the employee's hourly or <br />salary rate at the time request for payment is made by the employee. <br />(f) Accumulated vacation leave which is neither used during the one-year period following the <br />one-year period in which it was earned, carried over into a succeeding year, or paid, pursuant to, <br />respectively, paragraphs (b), (c) and (d) above, shall be forfeited. <br />(g) Lateral Transfers. Employees hired by the City may be credited at the time of hire <br />• with vacation service credit in additional to City time based upon the schedule and receive <br />
