Overview <br />The predecessor agreement between City of North Olmsted (hereafter the "City" or "Employer") <br />and the OPBA (hereafter the "Union") expired December 31, 2023, and covers all full-time <br />Emergency Central Dispatchers. The following outlines the changes to be made to the parties' <br />Agreement should the tentative agreements be accepted by the City. All articles not specifically <br />addressed herein are to remain current contract language. Throughout the Agreement there are <br />minor contract "clean up" changes, such as renumbering, deleting expired language, and titling of <br />sections to allow for easy and quick identification of applicable contract language. These non - <br />substantive changes are not summarized in full here. <br />Article 1. Preamble/Purnose <br />The parties agreed to restructure this language as a true preamble, outside of the body of the <br />agreement. In doing so, feel good language was deleted from the CBA that was not substantively <br />relevant to wages, hours, terms and conditions of employment. <br />Article 1. Union Recognition <br />The parties agreed to add the statutory basis for exclusions to the recognition clause to supplement <br />the current "all other employees of the Employer." <br />Article 3, Dues Deductions <br />The parties agreed to delete the previously required fair share fee language from Section 4 and 5 <br />as it is illegal now. Instead, the parties agreed to add language that states "If the Janus decision is <br />reversed, the parties will meet to negotiate an alternative procedure" <br />Article 4. Non -Discrimination <br />The parties agreed to delete language that lists out protected classes. That language is replaced <br />with a recognition and acknowledgment that any allegation of discrimination based on a legally <br />protected classification under State or Federal law shall be processed through external <br />administrative agencies (EEOC/OCRC). <br />An Interactive Dialogue section is added as an opportunity for the Employee and employees to <br />resolve any issue that may be filed with the EEOC, OCRC, etc. <br />The parties agreed to delete Article 37's gender neutral section and relocate it here to Article 4. <br />Article 6, Internal Investigations <br />The parries added a section that acknowledges any time an employee is to be interviewed on an <br />issue implicating discipline, the employee shall be given appropriate time to obtain legal counsel <br />or a representative of the bargaining unit. <br />Language in Section 5 was deleted that stated where the official personnel files were located <br />4891-94238183,, 2 <br />
