In the case of an internal investigation, such interrogation shall be recorded by the police <br />department at the request of either party. A copy of the tape will be made available to the FOP. <br />24•:9822.10. The violation <br />shall be noted and may be presented to the person or the court that will be making judgment on <br />the case that is presented. <br />ARTICLE 23 <br />LAYOFF/RECALL <br />22.9423.01. Notice. Whenever the Employer determines a layoff is necessary due to lack of <br />funds, lack of work or that a reorganization in the operations of the Employer is necessary, a <br />reduction in force, i.e., a layoff or job abolishment efpoailiom shall occur. The Employer shall <br />notify the affected employees in writing at least thirty (30) days in advance of the effective date of <br />layoff. <br />23.92 23.02 Order of Lavoff/Disnlacement Rights. The Employer will determine in which <br />classificadon(s)1rank(s) a reduction is to be made, and within the affected classifcation/rank, <br />the employee(s) with the least time in rank within the effected classification/rank will be thefrst <br />laid off. Employees who are laid off may displace (bump) another employee with the least <br />seniority in a lower rated job classification rank within the classification series of corrections <br />officer. Employees who are displaced (bumped) by a more senior employee shall be able to <br />displace (bump) another employee with the less seniority in a lower rated job classification/rank. <br />At the end of the bumping process, the employee who is displaced (bumped) and unable to <br />displace (bump) another employee (meaning that the corrections officer with the least amount <br />of continuous, full-timeservice as a corrections officer with the City of North Olmsted) pursuant <br />to the above provisions shall be laid off. <br />A. "Tithe in Rank" in terms of seniority, as used herein, shall mean the date continuous service <br />began in a rank classification. For purposes of calculating time in rank seniority and <br />bumping rights, any employee attempting to displace from higher corrections rank into <br />a lesser rank shall displace the unit member with the least senior time in grade and be <br />deemed at that point to be the most senior member in that rank. If a corrections sergeant <br />is attempting to displace into the rank of corrections officer during this process, he will <br />displace the least senior corrections officer and be placed on the seniority list for <br />corrections officer based on the total amount of continuous full-time service as a <br />corrections offcer with the City of North Olmsted <br />B. "Continuous service" means the uninterrupted service of an employee in a rank <br />classification or classifications, as applicable. <br />2393 23.03. Recall Rights. Employees shall remain on a layoff list for four (4) years as long as <br />the employee maintains his or her certification. The Employer shall recall from that list in the <br />reverse order in which the employees were laid off before hiring anyone else. Employees reduced <br />in rank, but not laid off, shall maintain recall rights to their previous rank without any time <br />limit. <br />26 <br />4863-57M9656, v.5 <br />
