CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2025 - 14 <br />By: Mayor Jones <br />A RESOL UTION A UTHORIZING THE MAYOR TO APPLY FOR, AND THE <br />MAYOR TO ACCEPT AND ENTER INTO A WATER POLLUTION <br />CONTROL LOAN FUND AGREEMENT OR AGREEMENTS ON BEHALF <br />OF THE CITY OF NORTH OLMSTED, OHIO, FOR THE PLANNING, <br />DESIGN AND/OR CONSTRUCTION OF THE SOUTH INTERCEPTOR <br />EQUALIZATION FACILITY, • AND DESIGNATING A DEDICATED <br />REPAYMENT SOURCE FOR THE LOAN OR LOANS, AND DECLARING <br />ANEMERGENCY. <br />WHEREAS, the City of North Olmsted, Ohio seeks to upgrade its existing wastewater <br />facilities; and <br />WHEREAS, the City of North Olmsted, Ohio intends to apply for a loan(s) from the <br />Water Pollution Control Loan Fund (WPCLF) for the planning, design and/or construction of the <br />South Interceptor Equalization Facility; and <br />WHEREAS, the Ohio Water Pollution Control Loan Fund requires the government <br />authority to pass legislation for application of a loan(s) and the execution of an agreement or <br />agreements, as well as designating a dedicated repayment source. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OFOHIO: <br />SECTION 1: That the Mayor be and she is hereby authorized to apply for a WPCLF <br />loan or loans, and the Mayor be and is hereby authorized to sign all documents for and enter into <br />a Water Pollution Control Loan Fund agreement or agreements with the Ohio Environmental <br />Protection Agency and the Ohio Water Development Authority for the planning, design and/or <br />construction of the South Interceptor Equalization Facility on behalf of the City of North <br />Olmsted, Ohio. <br />SECTION 2: That the dedicated source of repayment for said loan or loans will be the <br />user fees from the Sewer Revenue Fund. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Resolution go into effect immediately to meet the loan <br />application approval process deadlines of the WPCLF, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />
