CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2025 - 11 <br />By: Mayor Jones <br />AN ORDINANCE GRANTING A 0.01 ACRE ACCESS EASEMENT <br />ACROSS PERMANENT PARCEL NUMBER 231-27-067, LOCATED <br />ADJACENT TO THE RIGHT OF WAY ON WOODSIDE DRIVE, FOR <br />THE PURPOSE OF DRIVEWAY ACCESS FOR NEW HOME <br />CONSTRUCTION PROPOSED AT PERMANENT PARCEL 131-30- <br />012, AND DECLARING AN EMERGENCY. <br />WHEREAS, property owner Mejdi Elder, owner of PPN 231-30-012, is preparing to <br />undertake residential construction on Woodside Drive (herein "Project") and has requested an <br />Access Easement across PPN 231-027-067, in order to construct a driveway and apron to the <br />right of way, to wit, Woodside Drive; and <br />WHEREAS, in planning for the Project, it was determined by the City that 0.01 acres of <br />real estate on PPN 231-27-067 (hereinafter "the Property'), located adjacent to the right of way <br />known as Woodside Drive, was needed for access; and <br />WHEREAS, the City acquired the Property through the North Ohnsted Land <br />Reutilization Program, as it was a block of land functionally equivalent to the tree lawn, near the <br />entrance to Woodside Drive; and <br />WHEREAS, the City of North Olmsted, on behalf of the North Olmsted Land <br />Reutilization Program, negotiated the granting of an Access Easement, a copy of which is <br />attached hereto as Exhibit A; and <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of the <br />Director of Law and the City Engineer, to grant the Access Easement and to provide for the <br />recording of such conveyance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: It is determined by this Council that the Property to be conveyed and <br />identified in the Access Easement attached as Exhibit A hereto, is not needed for public purpose, <br />is not buildable, and the conveyance of the Access Easement is necessary in order to enable <br />access the right of way known as Woodside Drive for the Project. <br />SECTION 2: That the Mayor is hereby authorized and directed to grant, on behalf of the <br />North Olmsted Land Reutilization Program, an Access Easement across PPN 231-27-067 to <br />Mejdi Elder, owner of PPN 231-30-012, as further described within said document, marked as <br />Exhibit A attached hereto and incorporated herein by reference. <br />
