CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2025 - 9 <br />BY: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH RINI BROS., LLC TO PURCHASE 1.2313 ACRES <br />OF A PARCEL OF REAL PROPERTY COMMONLY KNOWN AS <br />PERMANENT PARCEL NUMBER 233-26-067. <br />WHEREAS, the City of North Olmsted is authorized to enter into an agreement to sell <br />the property formerly known as Forest Elementary School to a developer selected in the <br />Request for Proposal ("RFP' process for the Forest Elementary School Redevelopment <br />Project ("Projeef'); and <br />WHEREAS, as set forth in the RFP document, the Project requires access to Steams <br />Road from the former Forest Elementary School Property; and <br />WHEREAS, a portion of Permanent Parcel Number 233-26-067 lies between the <br />former Forest Elementary School property and access to Steams Road; and <br />WHEREAS, the City acquired an appraisal for the portion of Permanent Parcel <br />Number 233-26-067 necessary for access to Steams Road from the Forest Elementary School <br />Property and owned by RINI Bros., LLC; and <br />WHEREAS, RIM Bros., LLC offers to sell and the City of North Olmsted proposes to <br />purchase approximately 1.2313 acres of PPN 233-26-067, in consideration of payment in the <br />amount of Fifteen Thousand Dollars ($15,000.00); <br />WHEREAS, it is the desire of Council to authorize the Mayor to enter into an <br />Agreement with RIM Bros. LLC to purchase approximately 1.2313 acres of PPN 233-26-067, <br />for Fifteen Thousand Dollars ($15,000.00). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor and Director of Law be and are hereby authorized to <br />negotiate and enter into an agreement with RINI Bros. LLC for the purchase of approximately <br />1.2313 acres of PPN 233-26-067, in consideration of payment in the amount of Fifteen <br />Thousand Dollars ($15,000.00), based on and consistent with the Agreement and supporting <br />documents attached hereto as Exhibit A. The Agreement with RINI Bros., LLC shall be in the <br />form and substance as set forth on Exhibit A, with such changes in form and substance that <br />are not substantially adverse to the City and which are approved by the Director of Law. The <br />character of the agreement as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the agreement by the Mayor and the approval of the contract <br />by the Director of Law. <br />
