CITY OF NORTH OLMSTED RESOLUTION NO. 2025 - 20 By: Mayor Jones A RESOLUTION AUTHORIZING THE MAYOR TO TERMINATE THE CURRENT CONTRACT FOR PINE BROOK WETLANDS MITIGATION BANK CREDITS ACQUIRED VII ORD. 2012-87 AND FURTHER AUTHORIZING THE MAYOR TO PURCHASE REPLACEMENT WETLANDS MITIGATION CREDITS FROM GRANGER WETLANDS MITIGATION BANK AT A COST OF $704,000.00, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted, in connection with the South Interceptor Equalization Tank Project, must fulfill wetlands mitigation in compliance with Section 404 of the Clean Water Act and ORC Chapter 6111 for the "discharge of dredged or fill materials into waters of the United States and waters of the State of Ohio, including wetlands"; and WHEREAS, the Stream + Water Foundation is a non-profit organization pre -approved by both the Ohio EPA (OEPA) and the US Army Corps of Engineers (USACE) to serve as the Mitigation Bank for the State of Ohio; and WHEREAS, Council previously authorized the Mayor to acquire 3.0 wetlands mitigation credits from Pine Brook Wetlands Mitigation Bank at a cost of $150,000.00. Under the current proposal, if the City returns the 3.0 credits acquired from Pine Brook, it can acquire 1.6 credits from Granger Wetlands Mitigation Bank at a cost of $104,000.00, resulting in a savings of $46,000.00; and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into the Wetlands Mitigation Purchase Agreement at a cost of $104,000.00 with Granger Wetlands Mitigation Bank and to further authorize the Mayor to take all steps necessary to achieve a refund / credit of $150,000.00 for voiding the Pine Brook Wetlands Mitigation Bank Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and she is hereby authorized to enter into a Wetlands Mitigation Purchase Agreement with the Stream + Wetlands Foundation to reserve mitigation credit with the Granger Wetlands Mitigation Bank, as detailed by Exhibit A attached hereto, at a cost of $104,000.00, with such amendments as may be deemed necessary by the Director of Law. The Mayor is further authorized to obtain a credit or refund from voiding / cancelling the previously -authorized Pine Brook Wetlands Mitigation Bank wetlands mitigation bank credits previously authorized and acquired via Ord. 2022-87 at a cost of $150,000.00.
