CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2025 - 8 <br />BY: Mayor Jones <br />AN ORDINANCE AMENDING SECTION 928.15 "BOND" OF <br />CHAPTER 928 OF THE STREETS, UTILITIES AND PUBLIC <br />SERVICES CODE ENTITLED "COMPREHENSIVE STORMWATER <br />MANAGEMENT" TO REVISE BOND REQUIREMENTS WHEN A <br />COMPREHENSIVE STORMWATER MANAGEMENT PLAN IS <br />REQUIRED, ASAMENDED. <br />WHEREAS, the City of North Olmsted in 2019 implemented a new and revised <br />Chapter 928 in order to establish standards, principles, and procedures for the regulation of <br />soil disturbing activities that may increase flooding and erosion and may cause adverse <br />impacts to water resources, resulting from stormwater runoff; and <br />WHEREAS, the current Chapter 928 requires the positing of a cash bond to ensure <br />compliance with the Storm Water Management Plan equal to ten percent (10%) of the total <br />project cost; and <br />WHEREAS, reviewing the ordinance, the City Engineer recommends that an <br />additional means method of paying the bond be permitted, to wit a surety bond, and he <br />further recommends that the bond a second bond amount calculation option be authorized <br />in an amount equal to one hundred percent (100%) percent of the cost of the stormwater <br />control meas ; and <br />WHEREAS, based upon the recommendation of the City Engineer, this Council <br />desires to amend Section 928.15 to create a new bond option and, further, to change the <br />amount and application of the cash bond requirement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO, THAT. <br />SECTION 1: That Chapter 928.15, "Bond" which presently reads in its entirety as <br />set forth herein shall be amended and as amended shall read in its entirety as set forth herein <br />with additional text in bold face and deleted text crossed out and stricken: <br />X.If6iSU:lta <br />(a) If a Comprehensive Stormwater Management Plan is required by this regulation, <br />soil -disturbing activities shall not be permitted until a cash or surety bond of one hundred <br />percent (100%) of the cost of the stormwater control measures consisting of stormwater <br />storage and water quality management facilities, of -t`-- amaunt dere.... fined by the City <br />Rngin , has been deposited with the City of North Olmsted Finance Department.
