SECTION 6: That in the event any such property owner shall fail, neglect or refuse <br />to construct and repair any such sidewalk herembefore specified in accordance with the plans <br />and specifications on or before Jme15,0 August 3, 2025 the City Engineer be, and <br />hereby is, authorized and directed to cause each such sidewalk to be constructed or repaired <br />in accordance with this Resolution and to make and return to Council the cost and expense <br />thereof. The entire cost of such work, which said lots and lands are hereby determined to be <br />specially benefited by said improvements, shall be assessed on the tax duplicate of the lot and <br />lands bounding and abutting on the sidewalk needing construction or repair. The cost of such <br />improvement shall include, but not be limited to, the cost of preliminary and other surveys, <br />plans, specifications, profiles and estimates, the cost of printing, serving, and publishing <br />notices, resolutions and ordinances, the cost of all special proceedings, the cost incurred in <br />connection with the preparation, levy and collection of special assessments, legal expense, <br />the cost of labor and materials and other necessary expenditures. <br />SECTION 7: That upon the City's completion of the construction and repair of the <br />sidewalks as provided in this Resolution, the City Engineer is hereby authorized and directed to <br />ascertain the total cost of such construction and repair along with a list of estimated <br />assessments against each abutting lot and parcel of land which shall be placed on file in the <br />Office of the Clerk of Council and be available for public inspection. <br />SECTION 8: That the Clerk of Council or her designee be, and hereby is, directed to <br />cause written notice of passage of this Resolution to be served upon the owners of the lots or <br />lands abutting upon the sidewalks to be constructed or repaired, as such are specified in <br />Exhibit A, in the manner provided and required by Ohio Revised Code section 729.03. <br />SECTION 9: That this Resolution shall take effect and be in force from and after the <br />earliest period allowed by law upon its passage and approval by the Mayor. <br />PASSED:vr <br />n.• <br />to�a, <br />BEATRICE T <br />Clerk of Council <br />2 <br />First Reading: %- a21 o7.i <br />Second Reading: ,T- 7- o2S— <br />Third Reading: =oZb o2� <br />Committee:_��'�- <br />—d�-4 <br />CHRISTOPH R SCARL <br />President Pro Tempore <br />
