that the mobile food vehicle is in compliance with all applicable federal, state, and local fire <br />safety and health statutes, regulations, ordinances, and codes. <br />(n) No owner or occupier of land (including lessees / tenants of land) within the City shall <br />permit a mobile food vehicle to operate upon property in its name or property under its <br />control when the mobile food vehicle is in violation of any provision of this chapter. <br />§ 735.09 ENFORCEMENT. <br />(a) Enforcement. The provisions of this chapter may be enforced by the Public Safety <br />Director, the North Olmsted Police Department, North Olmsted Fire Department, and North <br />Olmsted Building Department. <br />(b) Revocation, suspension, modification. In addition to any other penalties specified in § <br />735.99, once a permit has been issued it may be revoked or suspended for failure to comply <br />with the provisions of this chapter. Anyone holding a permit that has been revoked or <br />suspended may, within ten days of notice of the same, appeal as is provided in § 735.05(c). <br />The Public Safety Director may suspend a permit for no more than three days without <br />notice or hearing, if the Public Safety Director notifies the permit holder in writing (email is <br />deemed an acceptable writing) that there is a probability of a violation of public safety <br />and/or health code. In such a case, anyone holding a permit that has been suspended may <br />request a hearing with the BZBA in accordance with the appeal procedure established <br />herein at § 735.05(c). <br />(O -d 98 2019, passed 7_8_0 <br />§ 735.10 SEVERABILITY. <br />If any provision of this chapter is held to be invalid by a court of competent jurisdiction, <br />then such provision shall be considered separately and apart from the remaining <br />provisions, which shall remain in full force and effect. <br />§ 735.11 INJUNCTIVE RELIEF. <br />It shall be unlawful for any owner /operator of a mobile food vehicle to violate any <br />provision or fail to comply with any of the requirements of this chapter. If an <br />owner/operator of a mobile food vehicle or an owner and / or occupier of land (including <br />lessees / tenants) has violated or continues to violate the provisions of this chapter, the <br />City of North Olmsted, in addition to any other remedies or penalties set forth herein, may <br />petition for a preliminary or permanent injunction. <br />§ 735.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a minor misdemeanor and shall <br />be subject to the penalty provided in § 501.99.
