We have all heard about the parking problems with this rezoning. Side lot, rear lot, over the
building and under the building are where parking for employees and customers are to be
located. There is also a provision that a building or store has no minimum parking
requirement. I understand that the current parking requirements need to be changed and
that shared parking needs to be introduced. Maybe a formula based on number of
employees and anticipated customer counts can be made to address this problem. One
store not having enough parking will cause that store's overflow parking to use another
store's parking. We discussed shared parking when the current zoning code was put in
place a few years ago. The question of legal liability came up. In addition, I don't see where
disabled, handicapped, and senior access has been addressed.
I believe that Council needs to ask the Legal Department for a legal opinion as to whether
This issue has to go to the ballot. This rezoning allows for many apartments. The City
Charter requires a zoning change that allows "Multiple Residence (Apartment) use, not
district, must be referred to the electorate. You need to have the Law Department's opinion
to become part of the permanent record either in committee or on the council floor.
I hope you all have had a chance to at least quickly review this zoning code change. The
most important function of Council is to establish zoning for the City. Zoning establishes
rules for permitted use, setbacks, lot sizes and much more for both residents and
business.
