the Director of Public Safety to cause the unsafe and dangerous structures located at 5035 <br />Porter Road in the City of North Olmsted to be demolished and removed in order to abate <br />the public nuisance arising therefrom, and to further authorize that the costs of demolition <br />and removal to be certified and placed upon the tax duplicate of the premises as a lien upon <br />said premises NOCO §§ 1363.108.7, 1364.107.4 and Revised Code§§ 715.26 and 715.261; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That this Council finds and determines, based on the Condemnation <br />Order dated 5/5/25, and the interested parties' failure to timely comply therewith, and the <br />persistence of nuisance conditions for over three (3) years notwithstanding repeated <br />enforcement actions in Court, that a public nuisance exists at 5035 Porter Road, and that <br />demolition of unsafe structures is necessary to protect the health, safety and general welfare <br />of the citizens. <br />SECTION 2: That the Clerk of Council be and she is hereby directed to serve a <br />copy of this Ordinance by certified mail to the titled property owner, lienholders and all <br />other persons having an interest in the property, as the names and addresses appear in the <br />records of the Building Commissioner, as required in Revised Code Sections 715.26 and <br />715.261. <br />SECTION 3: Not sooner than thirty (30) days after proof of service by certified <br />mail pursuant to Section 2, pursuant to R.C. 715.26 and 715.261, that the Director of Public <br />Safety be and she is hereby authorized to proceed with, negotiate contracts for, and initiate <br />all reasonable measures, either directly or through authorized agencies, including <br />cooperative agreements with the Cuyahoga County Land Bank, to demolish and remove <br />all unsafe and dangerous buildings located at 5035 Porter Road, City of North Olmsted, as <br />necessary to abate said public nuisance pursuant to Chapter 1363 and 1364 of the Codified <br />Ordinances, and further authorizing the Mayor to enter into said agreements for demolition <br />service, including with the Cuyahoga County Land Bank, to raze structures, which contract <br />shall be in a legal form and contain substance deemed necessary by the Director of Law. <br />The character of any such contract as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the approval <br />of the Agreement by the Director of Law. <br />SECTION 4: That the Clerk of Council be and she is hereby directed, with the <br />assistance and direction of the Director of Finance and the Director of Law, to certify the <br />total costs of abatement activity, including the cost of demolition, the cost of service, all <br />interest and penalties allowed by law, together with a proper legal description of the <br />premises at 5035 Porter Road, North Olmsted, Ohio to the office of the Cuyahoga County <br />Fiscal Officer, which shall thereby constitute a tax lien vested and granted priority pursuant <br />to Ohio Revised Code §§ 715.26 and 715.261. <br />
