CITY OF NORTH OLMSTED ORDINANCE NO.2025 - 85 BY: Mayor Jones AN ORDINANCE DISPENSING WITH THE REQUIREMENTS OF NORTH OLMSTED CODIFIED ORDINANCE SECTION 111.01, ENTITLED "CITY CONTRACTS INVOLVING THE RECEIPT OF FUNDS" AND AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH THE NORTH OLMSTED HOCKEY CLUB TO PROVIDE CONCESSION SERVICES AT THE RECREATION CENTER, AND DECLARING AN EMERGENCY. WHEREAS, Section 111.01 of the Codified Ordinances of the City of North Olmsted allows the Mayor to permit community groups or charitable groups to staff concession stands in public parks for a fee, but is silent about such activities at the Recreation Center; and WHEREAS, the North Olmsted Hockey Club has a history with the City of North Olmsted and has offered limited concession services in the past; and WHEREAS, the proposed term is August 22, 2025 and terminating on May 22, 2026, with the Hockey Club paying the City $100.00 a month; and WHEREAS, previous attempts to hire a concession company have been unsuccessful; and WHEREAS, Mayor Jones, Director Pinchek and Commissioner Drenski believe that it is best for the North Olmsted Hockey Club to provide basic, limited concession services to the patrons of the Recreation Center during mutually agreeable times and dates; and WHEREAS, it is the desire of this Council to dispense with the requirements of Section 111.01 of the Codified Ordinances of the City of North Olmsted and to authorize the Mayor to execute a concessions contract with the North Olmsted Hockey Club. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That the requirements of North Olmsted Codified Ordinance Section 111.01 be and are hereby suspended for this concession contract and the Mayor is authorized to execute a concession contract with the North Olmsted Hockey Club for services in substantially the form and substance as evidenced in the contract attached to this Ordinance as "Exhibit A," with only such changes to said contract to be hereinafter made as are not substantially adverse to the City and which are approved by the Director of Law. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the agreement by the Mayor and the approval of the agreement by the Director of Law.
