(3) Permits. The applicant is responsible for any plan reviews or permits that may be <br />required under the Ohio Building Code. Any approved artwork shall become part of the <br />property's approved development plan and provided to the Building Department for <br />property records. <br />(4) Publicity. The applicant may authorize and release publicity rights, including <br />photographic images, to the City on forms supplied by the Arts Commission. The consent <br />includes but is not limited to press, radio, films, television and all forms of social media, <br />including but not limited to the City's webpage, Facebook, Twitter, Instagram, etc., as <br />well as related agencies on the City's behalf. Absent consent, the applicant may initiate <br />its own publicity but agrees to provide the Arts Commission with an opportunity to <br />review and comment on any and all references to the North Olmsted Arts Commission. <br />(5) Maintenance. The applicant must agree to perform routine maintenance of the public <br />art and agrees to permit Building Inspectors and Arts Commission access to review and <br />recommend maintenance techniques to enhance the artwork. In the event that the <br />applicant determines to remove the artwork, due to passage of time or change in <br />circumstances, due to maintenance obligations or other causes, applicant shall notify the <br />Arts Commission. <br />(b) Review Criteria. The Arts Commission shall consider the following factors prior to <br />approval of any commercial prime property artwork application and installation <br />herein: <br />(1) Location. The application shall provide the address of the property and include a site <br />plan showing the location on the property where the artwork will be located. <br />(2) Type. The application shall indicate the type of artwork proposed. The Commission <br />shall determine what type of work is suitable for location and comprised of durable <br />materials for the intended lifespan of the work. <br />(3) Design and Intent. The Commission shall review the specific design concept of the <br />artwork. The Commission may consider what the art is meant to convey in context of <br />its environment. Any artwork that is deemed to have a commercial message shall be <br />denied and the applicant will be invited to consider alternate avenues for commercial <br />expression. <br />(4) Artist Capacity. The application shall contain an estimated date of commencement <br />and completion. The application shall include samples of the artist's portfolio and <br />experience with public art installations. <br />(5) Duration. The application shall include indication whether the artwork will be <br />displayed on a temporary or permanent basis. For temporary displays, the applicant <br />shall provide dates of display and a decommissioning/restoration plan for any site or <br />building modifications made to accommodate the artwork. <br />(6) Authorization and Release. The application shall address the property owner's <br />consent and approval of the proposed artwork, the artist's release of publicity rights to <br />the City, and the artist's limitation and release of VARA claims against the owner. <br />(7) Maintenance. The application shall require commitment from owner/operator to <br />maintain artwork over the proposed duration of its installation. The artwork shall be <br />maintained in the original approved condition. Any deviations from the original <br />proposal will require approval by the Arts Commission. If the artwork is not <br />maintained or conditions develop that pose a public health or safety risk, the city may <br />order the artwork's removal. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with <br />this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />2 <br />
