CITY OF NORTH OLMSTED RESOLUTION NO. 2025 -127 BY: Mayor Jones A RESOLUTION ADOPTING THE CITY OF NORTH OLMSTED CYBERSECURITYAND INCIDENT RESPONSE PLAN FOR CYBER SECURITY MATTERS IN ACCORDANCE WITH O.R.C. SECTION 9.64(C), AND DECLARING AN EMERGENCY. WHEREAS, on June 30, 2025, the adoption of Ohio House Bill 96 created Section 9.64 of the Revised Code which established compliance requirements for cybersecurity programs that safeguard the political subdivision's data, information technology, and information technology resources to ensure availability, confidentiality, and integrity; and WHEREAS, on August 27, 2025, the Auditor of State issued Bulletin 2025-007, requiring the legislative authorities of political subdivisions to adopt formal cybersecurity programs; and WHEREAS, as required by law, it is the desire of this Council to adopt the City of North Olmsted Cybersecurity and Incident Response Plan in accordance with O.R.C. Section 9.64(C). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: The City of North Olmsted adopts the City of North Olmsted Cybersecurity and Incident Response Plan consistent with the requirements of Ohio Revised Code Section 9.64(C) and Auditor of State Bulletin 2025-007. SECTION 2: The Mayor is hereby authorized to implement, maintain and update from time to time as may be required by law or due to changes in modern best practices for cybersecurity threats, the City of North Olmsted Cybersecurity and Incident Response Plan to ensure continued compliance with state law and general accepted cybersecurity practices. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Resolution go into effect immediately in order to comply with deadlines for adoption of a cybersecurity plan; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
