SECTION 6: That in the event such sidewalks are not constructed and repaired by the owners of the lots and lands abutting thereon, as identified on attached Exhibit A, in accordance with such plans and specifications and within the time prescribed in this Resolution, the City of North Olmsted will so construct and repair such sidewalks and assess the cost thereof against the lot and lands abutting thereon. SECTION 7: That in the event any such property owner shall fail, neglect or refuse to construct and repair any such sidewalks hereinbefore specified in accordance with the plans and specifications on or before June 1, 2026, the City Engineer be, and hereby is, authorized and directed to cause each such sidewalk to be constructed or repaired in accordance with this Resolution and to make and return to Council the cost and expense thereof. The entire cost of such work, which said lots and lands are hereby determined to be specifically benefited by said improvements, shall be assessed on the tax duplicate of the lot and lands bounding and abutting on the sidewalk needing construction or repair. The cost of such improvement shall include, but not be limited to, the cost of preliminary and other surveys, plans, specifications, profiles and estimates, the cost of printing, serving, and publishing notices, resolutions and ordinances, the cost of all special proceedings, the cost incurred in connection with the preparation, levy and collection of special assessments, legal expense, the cost of labor and materials and other necessary expenditures. SECTION 8: That the owners of said described lots and lands abutting such sidewalks as identified on the attached Exhibit A shall construct and repair the sidewalks in accordance with the specifications on file in the Office of the Clerk of Council. SECTION 9: That the Clerk of Council or her designee be, and hereby is, directed to cause written notice of passage of this Resolution to be served upon the owners of the lots or lands abutting upon the sidewalks to be constructed or repaired, as such are specified in Exhibit A, in the manner provided and required by Ohio Revised Code section 729.03. SECTION 10: That this Resolution shall take effect and be in force from and after the earliest period allowed by law upon its passage and approval by the Mayor.
