CITY OF NORTH OLMSTED <br />ORDINANCE NO.2026 -13 <br />BY: Mayor Jones <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A <br />CULTURAL PROJECT COOPERATIVE USE AGREEMENT WITH THE <br />OHIO FACILITIES CONSTRUCTION COMMISSION FOR THE PURPOSE <br />OF QUALIFYING CULTURAL PROJECTS FOR FINANCIAL INCENTIVES <br />OFFERED BY THE STATE OF OHIO. <br />WHEREAS, The City of North Olmsted, described as the Project Sponsor, has been invited <br />to enter into a Cultural Project Cooperative Agreement with the State of Ohio, by and through the <br />Ohio Facilities Construction Commission ("Commission"), a copy of which is attached as Exhibit <br />A; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to enter into the Cultural <br />Project Cooperative Agreement with the Commission for the purpose of providing for financial <br />incentives to induce Cultural Projects in the City; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTHOLMSTED, CUYAHOGA COUNTY, OHIO, THAT.• <br />SECTION 1: The Mayor, for and in the name of this City, is hereby authorized to execute <br />and deliver the Cultural Project Cooperative Agreement, attached as Exhibit A, with the State of <br />Ohio, by and through the Ohio Facilities Construction Commission, and any amendments thereto <br />that are not substantially adverse to the City and do not increase the percentage or number of years <br />of the tax abatement, provided further that the approval of changes, completions or amendments <br />thereto by that official, and their character as not being substantially adverse to the City, shall be <br />evidenced conclusively by the Mayor's execution thereof. This Council further hereby authorizes <br />the Mayor, the Director of Economic and Community Development, the Finance Director and the <br />Law Director, and other appropriate officers of the City, to sign those instruments and make those <br />arrangements as are necessary to carry out the purposes of this ordinance. <br />SECTION 3: This Council finds and determines that all formal actions of this Council <br />and any of its committees concerning and relating to the passage of this ordinance were taken in <br />an open meeting of this Council or any of its committees, and that all deliberations of this Council <br />and any of its committees that resulted in those formal actions were in meetings open to the public, <br />all in compliance with the law including ORC 121.22. <br />SECTION 4: That this Resolution shall take effect and be in force from and after the earliest <br />date provided for by law. <br />PASSED: `%� `7 o2� a First Reading: 02 -17-o249 <br />7— Second Reading: �3 -3 -� 1,o <br />Third Reading <br />_ — <br />Committee: <br />
