CITY OF NORTH OLMSTED <br />ORDINANCE NO.2026 - 47 <br />BY: Mayor Jones <br />AN ORDINANCE AMENDING SECTION 917.02 ENTITLED <br />"LIMITATIONS OF WASTEWATER STRENGTH" OF CHAPTER 917 <br />ENTITLED "INDUSTRIAL PRETREATMENT" OF THE STREETS, <br />UTILITIESAND PUBLIC SERVICES CODE IN ORDER TO COMPLY WITH <br />EPA REGULATIONS, AND DECLARINGANEMERGENCY, ASAMENDED. <br />WHEREAS, the Ohio Environmental Protection Agency, in the course of its routine review <br />of rules and regulations for operating systems at the North Olmsted Wastewater Treatment Plant, <br />recommended amendment of North Olmsted Codified Chapter 917; and <br />WHEREAS, the technical review and evaluation by the Ohio Environmental Protection <br />Agency is required as part of the NPDES permit renewal process; and <br />WHEREAS, it is the recommendation of the Administration that the City accept the <br />recommendation of the Ohio EPA and amend Chapter 917.02; and <br />WHEREAS, it is the desire of this Council, consistent with the recommendations of the <br />Administration and regulatory authorities, to amend said section. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 917.02 of Chapter 917 which presently reads in its entirety as <br />set forth in Exhibit A, which is attached to this Ordinance and incorporated by reference as if fully <br />rewritten herein, shall be amended and, as amended, shall read in their entirety as set forth in <br />Exhibit A, as such amendments are noted by highlighted additions and strikethrough deletions. <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent with this <br />Ordinance, is, to the extent of any such conflict or inconsistency, repealed. Conflicting or <br />inconsistent provisions of any Ordinance shall be corrected at re -codification. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further for <br />the reason that it is necessary that this Ordinance go into effect immediately to ensure the City is <br />in compliance with EPA rules and regulations, and further provided it receives the affirmative vote <br />of two-thirds of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />
