CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2026 - 78 <br />By: Mayor Jones <br />AN ORDINANCE AMENDING SECTION 303.08 ENTITLED <br />"IMPOUNDING OF VEHICLES; REDEMPTION" OF CHAPTER 303 <br />ENTITLED "ENFORCEMENT, IMPOUNDING AND PENALTY" OF <br />TITLE THREE ENTITLED "TRAFFIC CODE" OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, in order to provide greater clarity and to improve the process by which <br />the City regulates and enforces the impoundment and recovery of impounded motor <br />vehicles, particularly under circumstances where the underlying citation may be contested <br />by a motor vehicle owner, it is in the City's interest to amend Section 303.08 of the <br />Codified ordinances of the City of North Olmsted; and <br />WHEREAS, the Directors of Law and Public Safety, together with the Chief of <br />Police recommend that Section 303.08 entitled "Impounding of Vehicles; Redemption" of <br />the Traffic Code of the City of North Olmsted be amended; and <br />WHEREAS, this Council desires to amend the Code accordingly. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 303.08 entitled "Impounding of Vehicles; Redemption" <br />of the Traffic Code of the City of North Olmsted, which currently reads in its entirety as <br />set forth herein shall be and the same is hereby amended and shall read in its entirety as <br />follows, with such amendments denoted by bold face text for additions and stricken <br />language for deletions: <br />303.08 IMPOUNDING OF VEHICLES; REDEMPTION. <br />(a) Police officers are authorized to provide for the removal of a vehicle under the <br />following circumstances: <br />(1) When any vehicle is left unattended upon any street, bridge or causeway and <br />is so illegally parked so as to constitute a hazard or obstruction to the normal movement of <br />traffic, or so as to unreasonably interfere with street cleaning or snow removal operations. <br />(2) A. When any vehicle or "abandoned junk motor vehicle" as defined in Ohio <br />R.C. 4513.63 is left on a public street or other property open to the public for purposes of <br />vehicular travel or parking, or upon or within the right of way of any road or highway, for <br />forty-eight consecutive hours or longer, without notification to the Police Chief of the <br />reasons for leaving such vehicle in such place. <br />
