The vehicle shall not be released unless all towage and storage charges are paid in full. (c) No owner or operator shall remove an impounded vehicle from the place of storage without complying with the above procedure. Possession of a vehicle which has been impounded and unlawfully taken from the place of storage, by the owner or operator, shall constitute prima -facie evidence that it was so removed by the owner or operator. (d) The Director of Public Safety may designate one or more public garages or other premises as motor vehicle pounds. (e) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree. SECTION 2: That, in all other respects, the North Olmsted Code, as amended and supplemented from time to time, shall remain in full force and effect. SECTION 3: That all other ordinances or parts of ordinances or resolutions that are inconsistent or in conflict with the newly amended and adopted sections are likewise repealed to the extent of such inconsistency or conflict only. SECTION 4: That, if any section, paragraph, sentence, clause, phrase, term, provision or part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid or inoperative, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, sentence, clause, phrase, term, provision or part thereof directly involved in the controversy in which such judgment shall have been rendered. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that the City is in litigation regarding its parking ticket procedures and the immediate amendment of parking procedure will support the City's defense and settlement of claims; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
