s xw <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 - 22 <br />BY: Council Members Limpert and Gareau <br />AN ORDINANCE AMENDING SECTION 107.14 OF <br />CHAPTER 107 OF THE ADMINISTRATIVE CODE, <br />ENTITLED "ETHICS COMMISSION, POWERS AND <br />DUTIES," TO PROVIDE FOR A CHANGE IN THE <br />COMPOSITION OF THE CITY ETHICS COMMISSION, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City Ethics Commission, as established by Ordinance No. 81 -136, is <br />composed of the President of Council, the Director of Finance, the Director of Law, and two <br />members of City Council; and <br />WHEREAS, the Director of Law, in addition to his membership on the said Commission, <br />is required by both the City Charter and Chapter 107 to provide legal advice to the City Ethics <br />Commission; and <br />WHEREAS, the Director of Law, based upon his review of an opinion from the Ohio <br />Attorney General's office on the subject of public attorneys serving as voting members of boards <br />and commissions, has recommended that the Director of Law serve the City Ethics Commission <br />in a legal advisory role only, and <br />WHEREAS, the City Ethics Commission has met, and, in accordance with the <br />recommendation of the Director of Law, has unanimously recommended that Section 107.14 of <br />the City Ethics Code be appropriately amended to provide for the Director of Law to serve as a <br />legal advisor only to the City Ethics Commission; and <br />WHEREAS, it is the desire of this Council to amend the City Ethics Code appropriately <br />to provide for the Director of Law to serve as legal advisor only and for the Director of Personnel <br />and Administrative Services to serve as the fifth member of the Commission; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 107.14 of Chapter 107 of the Administrative Code, entitled <br />"Ethics Commission; Powers and Duties," which presently reads as follows: <br />"107.14 ETHICS COMMISSION; POWERS AND DUTIES. <br />(a) There is hereby established an Ethics Commission in the City which shall <br />consist of five members, namely, Finance Director, Director of Law, President of Council and <br />one Councilman at large and one Ward Councilman, both of whom shall be appointed by a <br />majority vote of Council. Neither the Ward Councilman nor the Councilman at large shall be of <br />the same political party, unless all members of Council are of the same political party. The <br />
