CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2005 —11 <br />BY: Council Member Gareau <br />AN ORDINANCE AMENDING SECTIONS 1363.08 AND <br />1363.10 OF CHAPTER 1363 OF THE REAL PROPERTY <br />MAINTENANCE CODE, BY REMOVING THE <br />ADMINISTRATIVE APPEAL AND VARIANCE <br />PROCEDURES CONTAINED THEREIN, AND OTHERWISE <br />STREAMLINING THE VIOLATION AND NOTICE <br />PROCEDURES CONTAINED THEREIN, IN ORDER TO <br />PROVIDE FOR MORE EFFECTIVE REAL PROPERTY <br />MAINTENANCE CODE ENFORCEMENT IN THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has recently spent considerable time and effort during the past <br />year reviewing the City's Real Property Maintenance Code, and appropriating funds for the hiring <br />of a new Property Maintenance Officer, in order to protect property values, promote good <br />neighborhoods, eliminate blight, and increase effective code enforcement in the City; and <br />WHEREAS, in the course of such review, this Council has determined that some <br />procedures available and applied to Real Property Maintenance Code enforcement in the last <br />decade, are no longer needed or effective in obtaining good code enforcement, and are not <br />required by due process; and <br />WHEREAS, at least nine years have passed since this Council last reviewed Sections <br />1363.08 and 1363.10 of the Real Property Maintenance Code, as these sections apply to Real <br />Property Maintenance Code enforcement in the City; and <br />WHEREAS, in those intervening years, the City of North Olmsted has become a more <br />mature community, and studies and surveys of the City's residential neighborhood reveal that a <br />number of properties, including residential properties, are not being kept and maintained in <br />accordance with the appropriate maintenance standards evident elsewhere within the residential <br />neighborhoods of the City; and <br />WHEREAS, this Council finds that a failure to maintain the exterior appearance of <br />residential properties creates nuisance conditions and blight within residential neighborhoods, that <br />have a deleterious effect upon property values and moreover detract from the quality of the living <br />experience in suburban neighborhoods; and <br />WHEREAS, it is accordingly the desire of this Council to amend Sections 1363.08 and <br />1363.10, by removing provisions therein for administrative appeals and variance processes, and <br />streamlining violation and written notice provisions, in order to more effectively enforce the <br />substantive provisions of the City's Real Property Maintenance Code in both residential and non- <br />
