CITY OF NORTH OLMSTED ORDINANCE NO. 2007 - 20 BY: Council Member Gareau AN ORDINANCE AMENDING SECTION 1126.11 (DEVIATIONS FROM APPROVED PLANS PROHIBITED) OF CHAPTER 1126 OF THE NORTH OLMSTED ZONING CODE IN ORDER TO REQUIRE THAT DEVELOPERS CERTIFY THAT SITE DEVELOPMENT PLANS AND BUILDING ELEVATIONS SUBMITTED TO THE CITY BUILDING OR ENGINEERING DEPARTMENTS INCORPORATE ALL REQUIREMENTS OF THE FINAL DEVELOPMENT PLAN APPROVED BY CITY COUNCIL. WHEREAS, this Council has observed that, on numerous occasions, developers have failed to construct buildings and other improvements in accordance with final development plans as approved by City Council pursuant to the provisions of Chapter 1126 of the City Zoning Code; and WHEREAS, this Council believes that many of these deviations from approved development plans have originated in the site development plans and/or building elevations submitted by developers to the City Building and Engineering Departments; and WHEREAS, it is the desire of this Council to amend Section 1126.11 of the Zoning Code to require that developers certify to the Building and Engineering Departments in all site development plans and building elevations submitted that said plans and elevations incorporate all requirements of the final development plan approved by City Council and that any deviations are noted therein; and WHEREAS, the Planning & Design Commission on the c?,? day of , 2007, by formal motion, (recommended - did not recommend) (with suggested changes that this Ordinance be adopted; and l WHEREAS, following publication of newspaper notice in conformance with thc provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zonin ode, a public hearing was held on this proposed legislation on the 3 day of , 2007; 61 NO W, THEREFORE, BE IT ORDAINED B Y THE CO UNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO:
