<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 63 <br />BY: Mayor O' Grady <br />? <br />AN ORDINANCE CREATING NEW SECTION 111.011 OF <br />THE ADMINISTRATIVE CODE, ENTITLED "CITY POLICE <br />TOWING AND STORAGE CONTRACTS, " IN ORDER TO <br />AUTHORIZE THE MAYOR TO EXECUTE TOWING AND <br />STORAGE CONTRACTS WITH TOWING CONTRACTORS <br />WHO MEET NORTH OLMSTED POLICE DEPARTMENT <br />RULES AND REGULATIONS. <br />WHEREAS, the North Olmsted Police Department, from time to time, and on a non- <br />consensual or involuntary basis, summons tows and orders vehicles into storage pursuant to <br />the provisions of Section 303.08 of the City Traffic Code; and <br />WHEREAS, the Chief of Police, at the request of the Mayor and Director of Public <br />Safety, has reviewed the manner in which such tows are conducted in North Olmsted, and, <br />after having completed said review, recommends that this Council adopt legislation requiring <br />that such tows be conducted by contractors who have entered into contracts with the City, and <br />further authorizing the Mayor to enter into contracts with any and all towing contractors who <br />meet police department rules and regulations for conducting non-consensual tows and storing <br />vehicles pursuant to such tows; and <br />WHEREAS, it is the desire of this Council, acting upon the recommendation of the <br />Chief of Police, to create new Section 111.011 of the Administrative Code providing for all <br />police department non-consensual tows to be conducted by towing contractors who have <br />entered into contracts with the City, and authorizing the Mayor to enter into contracts with any <br />towing contractor who meets police department rules and regulations for conducting non- <br />consensual tows; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created new Section 111.011 of Chapter 111 <br />("City Contracts") of the Administrative Code of the City of North Olmsted, which, as <br />created, shall read in its entirety as follows: <br />"111.011 CITY POLICE TOWING AND STORAGE CONTRACTS. <br />(A) Except under emergency circumstances which prevent strict compliance with the <br />provisions of this Section, the North Olmsted police department, when calling for tows <br />and ordering vehicles into storage pursuant to the provisions of Section 303.08 of the <br />Traffic Code, shall only call towing contractors that have entered into contracts with <br />the City pursuant to the provisions of this Section. <br />
