,.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2007 - 73 <br />BY: Mayor O'Grady <br />AN ORDINANCE A UTHORIZING THE MA YOR TO ENTER INTO <br />AN AGREEMENT WITH THE GREATER CLEVELAND REGIONAL <br />TRANSIT AUTHORITY ("GCRTA"), PROVIDING FOR THE <br />MAINTENANCE AND REPAIR C4STS FOR KENNEDY RIDGE <br />ROAD, INCLUDING THE TERMINUS THEREOF, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Greater Cleveland Regional Transit Authority ("GCRTA") has <br />acquired praperty on Kennedy Ridge Road and has been engaged in the planning and <br />development with the City of North Olmsted to expand its Park N Ride; and <br />WHEREAS, GCRTA proposes an Agreement with the City to, amongst ather <br />things, provide funding for the cost of maintenance and repair of Kennedy Ridge Road, <br />including the "hammerhead" terminus proposed thereon; and <br />WHEREAS, based upon the recommendations of the Director of Public Service <br />and the City Engineer, upon the advice and assistance of the Director of Law, it is the <br />desire of this Council to authorize the Mayor to enter into an Agreement with GCRTA <br />providing for its obligation and contribution toward the maintenance and repair costs for <br />Kennedy Ridge Road, including the "hammerhead" terminus thereof; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF CIHIO: <br />SECTION 1: That the Mayor be anct he hereby is authorized, on behalf of the <br />City of Narth Olmsted, to enter into and execute an Agreement with the Greater <br />Cleveland Regional Transit Authority ("GCRTA"), providing for the payment af <br />compensation in the amount of twenty-four thousand ($24,000.00) to the City of North <br />Olmsted, to be contributed toward the maintenance and repair costs for Kennedy Ridge <br />Road, as well as to outline addition maintenance obligation of GCRTA within the <br />"hammerhead" terminus thereof. The Agreement shall be in form and substance <br />substantially similar to the "Kennedy Ridge Maintenance and Repair Cost Agreement, ` <br />attached to this legislation as Exhibit A, with only such changes to be hereinafter made as <br />are not substantially adverse to the City of North Olmsted and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to <br />the City shall be evidenced canclusively by the execution of the Agreement by the Mayor <br />and the approval of the Agreement by the Director of Law. <br />??.?. .., . <br />.
