<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -133 <br />BY: Mayor Musial. <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A <br />ONE-YEAR PERSONAL SERVICES AGREEMENT WITH THE LAW <br />FIRM OF RADEMA%ER, MATTY, McCLELLAND & GREVE TO <br />PROVIDE PROFESSIONAL AND SPECIALIZED LEGAL <br />SERYICES, AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, it is the recommendation of the Director of Law and the Director of <br />Personnel & Administrative Services that the City enter into a personal services contract <br />with the law firm of Rademaker, Matty, McClelland & Greve to provide professional <br />legal services; and <br />N'HEREAS, this Council has, by Ord. No. 2002-72 established, in part, Section <br />111.08, NOCO, and provided for Exceptions from the Request for Proposals (RFP) <br />process in order to expressly authorize the Mayor to enter into corrtracts for specialized <br />legal services; and <br />WHEREAS, it is finding and desire of this Council to follow the <br />recommendation of the Directors of Law and Personnel, grant an Exception from the RFP <br />process, and to authorize the Mayor to enter into a personal services contract for <br />specialized legal services; and <br />WHEREAS, under the City Charter, only the Mayor may enter into contracts on <br />behalf of the City and a copy of the instant proposal is attached hereto; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an <br />Agreement with the law firm of Rademaker, Matty, McClelland & Greve for the purpose <br />of providing specialized professional legal services to the City. The term of the <br />Agreement shall be retroactive to the egpiration date of the previous one-year <br />Agreement authorized by Ordinance 2003-115 (passed August 5, 2003) and continue <br />through December 31, 2005. The Agreement shall be substantially in the form of the <br />retainer letter attached to this Ordinance as Exhibit A. <br />SECTION 2: That there are sut?icient funds appropriated for said services to <br />authorize this contract expenditure, to be utilized on an as needed basis, and as referred <br />by the Directors of Law and Personnel, in an amount not to exceed Fifteen Thousand <br />($15,000.00) $5;899 Dollars.
