<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 - 91 <br />BY: Mayor Musial <br />A RESOL UTION A UTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO A CONTRACT WITH D. B <br />HARTT, ING FOR THE PURPOSE OF PROVIDING <br />SPECIALIZED PI.ANNIIVG SERVICES TO THE CITY IN <br />CONNECTION WITH THE PREPARATION OF THE CITY'S 2004 <br />MASTER PLAN, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City's Charter requires that the Planning Commission, every four <br />years, prepare a Master Plan for the City; and <br />WHEREAS, the Director of Planning has initiated a process to assist the Planning <br />Commission in preparing this year's Master Plan; and <br />WHEREAS, the City applied for and this Council accepted a Community Development <br />Block grant from Cuyahoga County in the amount of $22,000, for the specific purpose of <br />retaining a planning consultant to provide specialized planning services needed in connection <br />with the preparation of the 2004 Master Plan; and <br />WHEREAS, the Director of Planning, acting in accordance with the terms and <br />conditions of the said Cuyahoga County grant, employed a selection process required by the <br />County to select a qualified planning consultant, and selected D.B. Hartt, Inc. as the most <br />qualified eonsultant to provide specialized planning services for the 2004 Master Plan; and <br />WHEREAS, because of the nature of the services being provided, the dollar amount <br />involved, and the terms and conditions of the grant from the County, it is not legally necessary <br />that this contract be either competitively bid in accordance with the provisions of the City <br />Charter or subject to the City's formal RFP process; and <br />WHEREAS, it is accordingly the desire of this Council, based upon the <br />recommendation of the Director of Planning, to authorize the Mayor to enter into a contract <br />with D.B. Hartt, Inc. to provide specialized planning services in connection with the <br />preparation of the 2004 Master Plan; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and is hereby authorized to enter into a contract with <br />D.B. Hartt, Inc. to provide specialized planning services to the City in connection with the <br />preparation of the 2004 Master Plan. Said contract shall be in the form of the Professional <br />Services Agreement attached to this Resolution as "Exhibit A," with only such changes therein <br />as are not substantially adverse to the City and which are approved by both the Mayor and the <br />Director of Law. The character of any such changes as not being substantially adverse to the <br />City shall be evidenced conclusively by the execution of the agreement by the Mayor and the <br />approval of the agreement by the Director of Law.
