<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2008 - 86 <br />By: Mayor O'Grady <br />A RESOL UTION A UTHORIZING THE MA YOR TO ENTER INTO A <br />CONTRACT WITH NOZZLE NEW INC. IN ORDER TO PRDVIDE FDR <br />THE REMOVAL OF ?'HE ABANDONED UNDERGROUND STORAGE <br />TANK AT THE SITE OF T1YE FORMER NOMBL BUS GARAGE, AND <br />DECLARING AN EMERGENCY. <br />WIEREAS, the Director of Public Service has been advised by the State of Ohio that the <br />abandoned underground storage tank at the site of the former NOMBL bus garage must be <br />removed or the City will be subjected to penalties, including significant fines; and <br />WHEREAS, it is the recommendation of the Director of Public Safety that the necessary <br />work be performed pursuant to contract with Nozzle New Inc., who is the only contractor in the <br />area available to do the work in accordance with State law requirements; and <br />WHEREAS, it is not necessary to competitively bid the said contract because the <br />expenditure to be made under it will not exceed $25,000.00; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into a contract with Nozzle New Inc. to provide for the removal of the abandoned undergnound <br />storage tank at the site of the former NOMBL bus garage; <br />NOW, THEREFORE, BE IT RESOLYED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a contract <br />with Nozzle New Inc. to provide for the removal of the abandoned underground storage tank at <br />the site of the former NOMBL bus garage. The contract shall be in form and substance <br />substantially similar to the attached "Contractual Agreement," having a total of four (3) pages, <br />marked as Exhibit A, and attached hereto, with only such changes to be hereinafter made in the <br />said contract as are not substantially adverse to the City and which are approved by the Director <br />of Law. The character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Agreement by the Director of Law.
