CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000 -18 <br />BY: Councilman Michael Gareau, Jr. <br />AN ORDINANCE VACATING A PORTION OF NORTHERN <br />AVENUE LOCATED IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Northern Avenue was dedicated for public use, as recorded in <br />Volume 111, Page 6 of Cuyahoga County Map records; and <br />WHEREAS, it has been deternuned by this Council that a portion of said <br />Northern Avenue is no longer needed for public use; and <br />WHEREAS, pursuant to Ohio Revised Code Section 723.05, Council may, on its <br />own authority, for good cause shown, vacate any street or portion thereof; and <br />? Z <br />WHEREAS, the Planning Commission on approved the <br />vacating of a portion of Northern Avenue, as more cl rly noted on "Exhibit A", which is <br />attached hereto and made part of this Ordinance, finding that it no longer is needed for <br />roadway purposes; and <br />WHEREAS, Council, upon hearing, is satisfied there is cause for such vacation, <br />and that it will not be detrimental to the general interest and out to be made. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That a portion of Northern Avenue, be and the same is hereby <br />vacated, as is more fully set out on the vacation plat marked "Exhibit A", which is on file <br />in the Office of the City Engineer, and which is made a part hereof. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure, <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the further reason that it is immediately necessary to clarify and give public notice of the <br />boundaries of any public street, and further provided it receives the affirmative vote of <br />two-thirds of all members of Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor.
