<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2000-7 <br />BY: Councilman Gareau <br />AN ORDINANCE ACCEPTING A STORM SEWER EASEMENT LOCATED ON <br />PROPERTY OWNED BY THE CLEVELAND ELECTRIC ILLUMINATING COMPANY <br />AND DESIGNATED AS PERMANENT PARCEL NO. 234-09-007 AND 234-09-008 ON TIiE <br />CUYAHOGA COUNTY MAPS AND RECORDS, SAID EASEMENT SHOWN ON EJuIIBIT <br />"A" AND DESCRIBED IN E7HIIBIT "B" AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has agreed to pay all costs and expense for the <br />construction of the storm sewer improvement within the easement area as shown on the Exhibit <br />«A,> and «B" <br />NOW, TI-IEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the City hereby accepts an easement from the Cleveland Electric Illuminating <br />Company for a storm sewer improvement, as shown on Exhibit "A" and "B". <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said <br />easement to be recorded in the office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health and safety of the City, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall talce effect <br />and be in foroe-i(nmediately upon its passage and approval by the Mayor. <br />PASSED: ;- L,?, <br />ATT?ST: f- ? <br />? <br />/$arbara L.
